Terms of Service
1. Who we are
Filesmithy (the “Service”) is operated by Cor Sawai, an individual sole proprietor (“we”, “us”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
The Service converts files you supply (for example, tracing a raster image into SVG or merging PDF documents) and returns the result to you. Processing happens on our servers.
3. Your content
You keep all rights in the files you upload and in the files we return to you. You grant us a limited licence to process your files solely to perform the conversion you requested and for no other purpose. We do not use your files to train models, and we do not sell them.
You are responsible for the files you upload. You represent that you own them or otherwise have the rights needed to upload and convert them, and that doing so does not break the law. See the Acceptable Use Policy, which forms part of these Terms.
4. Accounts and paid plans
Some features may require an account or payment. You are responsible for keeping your credentials secure and for activity under your account. Billing, refunds and cancellation are covered by the Refunds and Cancellation Policy.
5. Limits and availability
We apply size, page-count, rate and time limits to keep the Service usable for everyone, and we may change them. The Service is provided on an as-available basis. We may suspend, change or discontinue any part of it, and we may suspend or terminate access that breaches these Terms or the Acceptable Use Policy.
6. No warranty
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Conversion is automated and imperfect: we do not warrant that output will be accurate, complete or suitable for your purpose. Keep your own copies of your originals.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability arising out of or relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or USD 100.
Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
8. Indemnity
You will indemnify and hold us harmless against claims, losses and costs arising from files you upload or from your breach of these Terms.
9. Changes to these Terms
We may update these Terms. Material changes will be reflected in the “last updated” date above, and continued use after the change means you accept the revised Terms.
10. Governing law
These Terms are governed by the laws of the State of Alabama, United States, without regard to its conflict-of-law rules. Nothing here removes consumer rights that cannot be waived under the law of your country of residence.
